Title III of the Americans with Disabilities Act requires businesses open to the public to provide equal access. The Department of Justice has long said that includes websites, and courts regularly apply the ADA to the websites of businesses with a physical location; whether it reaches online-only businesses is still split between courts. There is no federal technical standard for private websites, so complaints and settlements measure sites against WCAG. Federal ADA website lawsuits reached 3,117 in 2025, up 27% year over year. Counting New York and California state courts as well, the 2025 total was 5,114. There is no size minimum under ADA Title III: any business with a website can be sued. Yes. After remediation you receive a WCAG conformance report and a RemediADA certificate recording what we tested, what we fixed, and the date. It is our own attestation of the work we did, not a government or third-party certification, and no official ADA certification exists for anyone to issue. Monitoring subscribers receive an updated certificate monthly. These documents are commonly requested by enterprise buyers, legal teams, and government agencies.

No overlay can promise that. In April 2025 the FTC announced a $1 million order against an overlay provider over false compliance claims.
