Terms of Service

Section 1

Service Description

RemediADA ("the Service," "we," "us," or "our") is a software platform operated by Tractus Holdings that provides automated website accessibility scanning, AI-assisted source-code remediation, and ongoing conformance monitoring. Our scanning engine runs axe-core alongside keyboard navigation testing and AI-powered visual analysis to detect violations of the Web Content Accessibility Guidelines (WCAG) 2.1 Level A and Level AA. Our remediation services, available on paid plans, generate and apply source-code fixes to supported platforms through the platform's own APIs. Our monitoring subscriptions re-scan on a schedule, issue updated conformance reports, and alert you when new violations appear.

By accessing or using RemediADA, you agree to these Terms of Service. If you do not agree, do not use the Service.

Section 2

Scope and Limitations of Automated Testing

IMPORTANT: Automated scanning detects approximately 50–70% of WCAG 2.1 AA criteria. Automated reports do not constitute legal advice and do not guarantee compliance with the Americans with Disabilities Act or any other law.

No automated tool can detect all accessibility barriers. Manual testing with assistive technologies (screen readers, switch access devices, magnification software) is required for comprehensive conformance and is strongly recommended before relying on any compliance score or report for legal or regulatory purposes. Our reports are based on automated technical analysis and should not be considered a substitute for manual expert review by accessibility professionals or testing with users who have disabilities.

Automated testing is particularly limited in detecting: semantic meaning in content, quality of alternative text, correctness of reading order in complex layouts, usefulness of focus order, and any barrier that requires human judgment about context. You are responsible for supplementing automated findings with manual review when your risk profile requires it.

No Legal Guarantee

OUR SERVICES DO NOT CONSTITUTE LEGAL ADVICE AND DO NOT GUARANTEE PROTECTION FROM ADA LITIGATION.

We are not a law firm. Our assessments are technical, not legal. Nothing in a compliance score, audit report, conformance certificate, or VPAT document we produce constitutes a legal opinion or an assurance of compliance with the Americans with Disabilities Act, Section 508, the European Accessibility Act, or any other accessibility law. If you need legal counsel, consult an attorney qualified in disability rights law.

Section 4

Remediation Services

Our remediation services apply AI-generated source-code fixes directly to your website through platform-specific APIs. Supported platforms currently include WordPress (via REST API and application passwords), Shopify (via Admin API), Wix (via Velo REST API), Webflow, and custom-coded sites (via GitHub pull request).

Fixes are applied only with your explicit consent. Before any fix is written to your platform, you must review and approve the remediation in your dashboard. We will not modify your website without an affirmative approval action from an authorized account holder.

Every applied fix is written to the fix_snapshots audit trail with the original HTML before our change, the fixed HTML after our change, the resource path that was modified, the timestamp, and a reference to the violation that triggered the fix. This audit trail is available to you through your dashboard and supports full or partial rollback at any time. Rollback is a self-serve operation available from the dashboard for the life of your account.

You warrant that you have the authority to authorize the platform access and modifications described above. We will only modify resources you have granted us access to, and we will not modify templates, themes, or code outside the scope of the violations you have approved for remediation.

Section 5

Rollback Policy

All remediation changes are tracked with before/after snapshots. You may request rollback of any or all applied fixes through your dashboard at any time by using the "Rollback" controls on the affected remediation job. Rollback reverts the platform-level content to the exact HTML stored in the snapshot and marks the snapshot as rolled back in our audit log.

In the event of a payment dispute or chargeback, applied fixes may be automatically reversed. See Section 14 — Chargeback and Dispute Policy for details.

Rollback is best-effort on platforms that do not expose a content-update API (Wix, Webflow, Squarespace). Where a platform restore cannot be automated, we provide you with the stored original content so you can manually restore it.

Section 6

Platform Access and Credentials

To perform remediation we require credentials to the platforms you want us to modify. All credentials are encrypted at rest using AES-256-GCM with a key derived via scrypt, and are only decrypted within the remediation worker at the moment a fix is applied. You can revoke platform access at any time through your dashboard; we will stop applying new fixes immediately and any in-flight fix will be rolled back if it fails to complete.

We will only use your platform access for authorized remediation work you have explicitly approved. We will never use platform access to read content unrelated to the violations we are fixing, and we will never share platform credentials with third parties.

Section 7

Scanning Third-Party Websites

The free scan and audit report features scan publicly accessible pages of a URL you submit. Our scanner identifies itself with a descriptive user agent, respects robots.txt directives except for legitimate accessibility auditing, rate-limits its own requests to avoid overloading the target, and does not attempt to bypass authentication, CAPTCHAs, or access controls. We do not store a full copy of any third-party website beyond what is necessary to generate a report.

You may only submit URLs that you own, operate, or have permission to audit. Submitting a URL you do not have permission to test is a violation of these Terms.

Section 8

Data Handling and Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated by reference into these Terms.

Customer website data (HTML, screenshots, violation reports, and source-code snapshots) is processed exclusively for the purpose of delivering the Service to you. We do not sell, license, or otherwise share customer website data with third parties except as follows:

  • HTML snippets and screenshots are sent to the Anthropic API for AI-powered visual analysis and fix generation. Anthropic does not use API inputs to train models. No personal account information accompanies scan data sent to Anthropic.
  • Scan data is stored in Supabase (our managed database provider) under row-level security policies that restrict access to your account only.
  • Error traces may be captured by Sentry for debugging purposes. We configure Sentry to exclude raw HTML content and credential values from error reports.

We retain customer website data for the periods described in our Privacy Policy, Section 8. After account deletion and the 30-day soft-delete window, all website data associated with your account is permanently deleted.

Section 9

Payment Terms

All payments are processed by Stripe, Inc. By providing payment information you agree to Stripe's Services Agreement. We do not store raw card numbers; Stripe stores your payment method under PCI DSS compliance and provides us with a token for future charges.

One-time services (Free Scan, Audit Report tiers, Remediation tiers) are charged once at purchase. Monitoring subscriptions are billed monthly or annually in advance on a recurring basis through Stripe and renew automatically until cancelled. You can cancel your subscription at any time from /dashboard/account or by contacting us at billing@remediada.com. Your subscription will remain active through the end of the current billing period, and no further charges will be made after cancellation.

One-time remediation charges are non-refundable once we begin applying fixes, because our work is immediately reflected in your live website. You may still request rollback under Section 5, but the monetary charge will not be refunded. Quotes provided by our sales team expire 48 hours after issuance unless a different expiration is stated on the quote. Any discount applied to a quote requires a documented business reason and is subject to a 30% maximum cap unless specifically approved by Tractus Holdings.

Section 10

Email Communications

We send two categories of email: transactional email (scan completion, report ready, receipts, password resets) and marketing email (outreach, product updates, newsletters). Transactional emails are tied to your account or a specific scan and are sent regardless of marketing preferences. Marketing emails are sent in compliance with the CAN-SPAM Act, include a valid physical mailing address in the footer, identify themselves as commercial messages, and include a one-click unsubscribe link that removes you from all marketing communications within 10 business days.

Section 11

Intellectual Property

The RemediADA software, scanning engine, remediation worker, admin dashboard, and accompanying documentation are the proprietary property of Tractus Holdings and are protected by United States and international copyright and trade-secret law. Your website content is yours. Source-code fixes we apply to your website become part of your codebase and are owned by you; we retain no rights to those modifications beyond the audit trail entries we store in our system.

Section 12

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE IS CAPPED AT THE GREATER OF (A) THE TOTAL FEES YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100).
  • WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, BUSINESS INTERRUPTION, WEBSITE DOWNTIME, DATA LOSS, OR THIRD-PARTY CLAIMS (INCLUDING ADA LITIGATION COSTS AND ATTORNEYS' FEES), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • WE MAKE NO WARRANTY, EXPRESS OR IMPLIED, THAT THE SERVICE IS FIT FOR ANY PARTICULAR PURPOSE, IS ERROR-FREE, OR WILL SATISFY ANY SPECIFIC LEGAL OR REGULATORY REQUIREMENT. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
  • BECAUSE AUTOMATED SCANNING COVERS ONLY 50–70% OF WCAG CRITERIA, WE EXPRESSLY DISCLAIM ANY REPRESENTATION THAT A PASSING SCORE OR COMPLETED REMEDIATION JOB RENDERS YOUR WEBSITE FULLY ACCESSIBLE OR LEGALLY COMPLIANT UNDER THE AMERICANS WITH DISABILITIES ACT, SECTION 508, THE EUROPEAN ACCESSIBILITY ACT, OR ANY OTHER STATUTE OR REGULATION.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you in full.

Section 13

Indemnification

You agree to defend, indemnify, and hold Tractus Holdings and its officers, employees, and agents harmless from any third-party claims, damages, liabilities, costs, and fees (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your website content; (c) your authority (or lack of authority) to grant us the access required to scan or remediate the websites you submit; and (d) any violation of these Terms by you or anyone acting on your behalf.

Section 14

Chargeback and Dispute Policy

If you initiate a payment dispute or chargeback against a charge from RemediADA, we reserve the right to immediately reverse all remediation changes applied to your website and to suspend your account pending resolution of the dispute. Fix snapshots enable precise rollback of our changes even after they have been applied. The automatic rollback includes restoring the original HTML content to the platform through the same API used to apply the fix, and recording the reversal in our audit log.

You agree that automatic rollback on chargeback is an appropriate remedy given that our work is permanent source-code modification of your website. Nothing in this section limits your right to raise a legitimate billing dispute through normal customer-support channels; please contact us before initiating a chargeback so we can resolve the issue without triggering an auto-rollback.

Section 15

Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles. Any legal action arising out of or related to these Terms or the Service must be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of those courts.

Section 16

Changes to Terms

We may update these Terms from time to time. For material changes we will provide at least 30 days' notice by email to the address on file and by posting the updated Terms at this URL. Your continued use of the Service after the notice period constitutes acceptance of the updated Terms.
